YOU ACCEPT THAT:
WA-Checker IS DESIGNED FOR LEGAL USE ONLY and it is a monitoring web system for smartphones that shall be used only with the intent of parental control, for employers to monitor the phones that they own and only to be used with the consent of the owner of a device.
Otherwise, it is possible that the applicable laws might be broken which could result in severe monetary and penal sanctions imposed to the infractor. You must consult your own legal advisor with respect of the legality of using the app in the way you intend before you start using it. WA-Checker will not be held responsible in any wat if a user chooses to monitor a phone that has no right to monitor. It is under your exclusive responsibility the good use of this tool.
YOU RECOGNIZE AND AGREE THAT YOU WILL NOT:
Use the WA-Checker services for any illegal purpose or which violates any law, including among, intellectual property laws, data privacy protection laws, and the import and export control; Publish, store, send, transmit or broadcast any information or material that will infringe patents, commercial brands, commercial secrets, copyright material of any kind; Use any robot, spider or another automatic mean to access the WA-Checker services for any purpose without our clear written consent or to omit our robot exclusion banners or other measures that we could use to prevent or restrict the access to the WA-Checker services or modify the WA-Checker services in any way, shape or form, nor to use modified WA-Checker versions, including but not limited to obtain unauthorized access to the WA-Checker services.
Sell or transfer or allow any other person access to the password of your account or to the WA-Checker services account.
Activate WA-Checker in a smartphone that does not belong to you.
Break federal and local laws of your country downloading and activating the WA-Checker service in someone’s smartphone.
Recover data using the WA-Checker service form a smartphone that does not belong to you without the knowledge and consent of the owner of the smartphone.
SUBSCRIPTIONS
To subscribe to the WA-Checker service (from now on called “the service”), you will need to make a purchase of WA-Checker. You are the only one responsible for any activity that occurs in your WA-Checker account. It is your responsibility to keep your account’s access information safe and avoid the unauthorized access to your account from third party members, any unauthorized person or unauthorized organization.
You are responsible of any activity that occurs in your WA-Checker account. WA-Checker does not control, monitor and or is unaware of the reason why a user exploits the application of the WA-Checker service and WA-Checker will not be held responsible of said use. The risk and responsibility of using the service is of the user only, in accordance with all the applicable documentation. WA-Checker is not responsible for the unauthorized and / or incorrect access of the WA-Checker service.
VIOLATIONS TERMINATION
You accept that WA-Checker can finalize or suspend your access to the WA-Checker service with no previous notice and no responsibility if said termination or suspension is based on (a) WA-Checker’s belief in good faith that you have violated any of the terms and conditions of this Agreement, (b) WA-Checker’s determination that you have or had broken the copyright of other repeatedly, ( c ) Long periods of inactivity with respect to any of the WA-Checker services.
INDEMNITY; KEEP INDEMNIAL
You will accept to compensate, defend and exempt WA-Checker, their afiliate companies and partners and providers (including, among others, the WA-Checker’s wireless service provider) of any responsibility, claim, demand, action, loss, cost, damages and any other responsibility, including the lawyers fees , that could come up or be related to (a) the use of misuse of the WA-Checker services, (b) any violation by you of any person’s rights or entity , or (c ) any breach or violation of this Agreement by you. WA-Checker reserves the right, you bearing the cost, of assuming the defense and exclusive control of any matter for which you will indemnify us, and you will accept to cooperate with our defense of this claims.
You agree to defend, indemnify and keep WA-Checker, their afiliates and officials, directors, agents and harmless employees of and against all claims, losses, damages, commitments, costs and expenses, including, lawyers fees, generated or related to your user’s content, site use or violation of any of these terms.
USER DATA
You will be solely responsible of your own user data and the consequences of storing or transmit them.
Wsponitor does not assume any responsibility in relation with the user data that comes from them or monitoring actively the user data in search for inappropriate content or ilegal. Wsp monitor does not backup or has control over the content of the user data sent by other users. WA-Checker reserves the right to avoid sending user data and restrict or delete user data for any reason at any time.
Privacy policy
It is our company policy that our client’s databases remain confidential and private. We have not sold, or ever will, sell names to “spammers” or other parties that wish to use our databases to advertise or request the use of their products or services. Your private information is safe with us.
We take all the reasonable precautions to protect the privacy of your information. When you send confidential information through the WA-Checker website, your information is protected online as well as offline.
MODIFICATION OF THIS AGREEMENT
Wsp monitor can change this terms of service. All and any of this changes to this agreement will be published in the WA-Checker.com website and you accept to be subjected to any change in the terms of service when you continue using the Wsp monitor service after the changes are published.
